Terms of Sale

1. General

These Terms of Sale apply to purchases made from Emma Lumière (“Emma Lumière”, “we”, “us”, or “our”) through emmalumiere.com (the “Website”).

By placing an order on our Website, you confirm that you have read and accepted these Terms of Sale and our Privacy Policy.

If you are under the legal age required to enter into a contract in your country, permission from a parent or legal guardian is required.

These Terms apply to consumers. If you purchase products on behalf of a company or other legal entity, separate terms may apply.


2. Prices and Payment

All prices on the Website are shown in the applicable currency and include VAT where required by law.

Shipping costs, if applicable, are clearly displayed during checkout before the order is confirmed.

We accept payment via credit/debit card, PayPal, and Klarna.

We reserve the right to correct pricing errors and to update prices without prior notice.


3. Orders and Order Confirmation

When you place an order, you will receive an automatic order confirmation by email. The purchase agreement is concluded once Emma Lumière confirms your order.

We reserve the right to cancel orders in situations such as product unavailability, technical errors, or incorrect pricing.

If an order is cancelled, any payment made will be refunded.

Products purchased as a consumer must be intended for personal use.


4. Delivery

Products are produced or prepared after an order has been placed. Estimated delivery times are displayed in the Shipping & Return Policy but may vary.

If a delivery delay occurs, we will inform you as soon as possible.

Delivery is considered completed once the goods have been received by you or a person acting on your behalf.

If a package is not collected from a pickup point within the carrier’s timeframe, we reserve the right to charge return shipping and a handling fee of 150 SEK.

We are not responsible for delays caused by circumstances beyond our control, including force majeure events.


5. Right of Withdrawal (EU Consumers)

In accordance with the EU Distance Selling Directive and Swedish distance selling legislation, you have the right to withdraw from your purchase within 14 days without providing a reason.

The withdrawal period begins on the day you receive the product.

To exercise your right of withdrawal, you must notify us by email at hello@emmalumiere.com

Please include:

  • your name

  • order number

  • a clear statement that you wish to withdraw from the purchase

To meet the deadline, it is sufficient to send the withdrawal notice before the 14-day period expires.


6. Returns and Refunds

If you withdraw from the purchase, we will refund the payment received from you, including standard delivery costs.

Refunds will be issued within 14 days after we receive the returned goods or proof that they have been shipped.

The refund will be made using the same payment method used for the original transaction.

The customer is responsible for the cost of return shipping.

Returned products must be in substantially unchanged condition. You are responsible for any reduction in value resulting from handling beyond what is necessary to inspect the product.


7. Warranty and Complaints

Under the Swedish Consumer Sales Act (Konsumentköplagen), consumers have the right to make a complaint about defective goods within three years from the date of delivery.

If a product is defective, you may be entitled to repair, replacement, price reduction, or a refund depending on the circumstances.

Complaints must be submitted within a reasonable time after the defect was discovered.

The legal warranty does not apply in respect of defects being caused by, for example, maltreatment, abnormal use, wear and tear, or accidents.

8. Limitation of Liability

Emma Lumière is not liable for indirect damages or losses that could not reasonably have been foreseen at the time of purchase.

Our liability is limited to the value of the purchased product unless otherwise required by mandatory consumer protection laws.

Product images on the Website are intended to represent our products as accurately as possible. However, colors and visual details may vary depending on your device, screen settings, and display resolution. As a result, the appearance of a product in images may differ slightly from the product received. Emma Lumière cannot guarantee that all colors are reproduced exactly and is not responsible for such variations.

While we strive to ensure that the Website operates smoothly at all times, Emma Lumière does not guarantee that the Website will be uninterrupted, secure, or free from errors. Temporary interruptions may occur due to maintenance, technical issues, or circumstances beyond our control.

The Website may contain links to third-party websites or services that are not operated by Emma Lumière. We do not control and are not responsible for the content, policies, or practices of any third-party websites.


9. Copyright & Trademark

All content on the Website, including but not limited to text, images, product designs, graphics, logos, and trademarks, is the property of Emma Lumière or its licensors and is protected by applicable intellectual property laws.

Such content may not be used, reproduced, or distributed without prior written permission.


10. Dispute Resolution

If you have a complaint, please contact us first so we can attempt to resolve the matter.

These Terms of Sale are governed by Swedish law.


11. Changes to These Terms

Emma Lumière reserves the right to update these Terms of Sale at any time. Changes will not affect purchases already completed.
